1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the website, services, and vehicle rentals provided by Swift Car Rental & Towing ("Swift Car Rental," "we," "us," or "our"), located at 6851 W Washington St, Indianapolis, IN 46241. By accessing our website, submitting a reservation request, or renting a vehicle from us, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Reservation Requests & Availability

All reservations submitted through our website or by phone constitute a reservation request, not a confirmed booking. Submission of a reservation request does not guarantee vehicle availability. A reservation is only confirmed when Swift Car Rental & Towing has reviewed your request, verified availability, and contacted you to confirm the reservation. Until you receive written or verbal confirmation from our team, no vehicle is reserved or held for you.

3. Reservation Deposit

A non-refundable $30.00 reservation deposit is required to submit and secure your reservation request. This deposit is separate from the rental price and is charged at the time you submit your reservation request. The deposit secures the processing of your request but does not guarantee vehicle availability or a confirmed reservation. The rental price for your selected vehicle is the amount charged for renting the vehicle and is due at the time of vehicle pickup or delivery, unless otherwise agreed in writing.

The refundability of the deposit and whether it is applied toward the final rental balance are determined at the discretion of Swift Car Rental & Towing and will be communicated to you at the time of confirmation. Any cancellation or refund policy will be provided to you in writing before your reservation is finalized.

4. Rental Price & Payment

The daily and weekly rental rates displayed on our website are estimates and are subject to change. The final rental price, including any applicable taxes, fees, surcharges, or additional services (such as delivery), will be confirmed by Swift Car Rental & Towing at the time of reservation confirmation. Payment for the rental is due at the time of vehicle pickup or delivery unless otherwise arranged. We accept major credit cards and debit cards.

5. Driver Requirements & License

To rent a vehicle from Swift Car Rental & Towing, you must:

• Be at least 21 years of age (drivers under 25 may be subject to additional fees or restrictions).
• Hold a valid, unexpired driver's license issued by a U.S. state or territory, or a valid international driver's permit.
• Provide clear photos of both the front and back of your driver's license at the time of reservation.
• Provide proof of current auto insurance coverage, if required by Swift Car Rental & Towing.
• Have a valid credit or debit card in your own name for payment and any security deposit.

Swift Car Rental & Towing reserves the right to refuse a rental to any individual who does not meet these requirements or whose driving record, license status, or credit profile is deemed unacceptable at our sole discretion.

6. Vehicle Use & Responsibilities

As the renter, you agree that you will:

• Operate the vehicle in a safe and lawful manner in compliance with all federal, state, and local traffic laws.
• Not use the vehicle for any illegal purpose, including the transport of illegal substances.
• Not use the vehicle for racing, off-road driving, ride-sharing or taxi services, or commercial hauling.
• Not allow any unauthorized individual to operate the vehicle.
• Not smoke or allow smoking inside the vehicle.
• Return the vehicle in the same condition as received, reasonable wear and tear excepted.
• Be financially responsible for all tolls, parking citations, traffic violations, and impound fees incurred during the rental period.

7. Damage, Loss & Insurance

You are responsible for any damage to, loss of, or theft of the vehicle during the rental period, regardless of fault. You are encouraged to carry personal auto insurance or purchase a collision damage waiver from Swift Car Rental & Towing, if offered. If you decline coverage, you assume full financial responsibility for the vehicle. Swift Car Rental & Towing is not responsible for personal items left in the vehicle.

8. Pickup & Delivery

Vehicles may be picked up at our location at 6851 W Washington St, Indianapolis, IN 46241, or delivered to an address you provide, subject to availability and applicable delivery fees. Delivery availability and fees are confirmed by our team at the time of reservation confirmation. You must be present at the agreed-upon pickup or delivery time with a valid driver's license and payment method.

9. Return of Vehicle

The vehicle must be returned on the agreed return date and time. Late returns may incur additional daily charges. Vehicles returned with less fuel than at pickup may be refueled by Swift Car Rental & Towing at your expense. Vehicles returned excessively dirty may be subject to a cleaning fee. Failure to return the vehicle by the agreed time may result in additional charges and, if not returned within 24 hours, may be reported as unauthorized use or stolen.

10. SMS & Email Communications

By providing your phone number and email address, you consent to receive communications from Swift Car Rental & Towing regarding your reservation, rental, or towing request. SMS messages are sent in accordance with the Telephone Consumer Protection Act (TCPA) and A2P 10DLC guidelines. Message frequency varies. Standard message and data rates may apply. You may opt out of SMS messages at any time by replying STOP. For assistance, reply HELP. Carriers are not liable for delayed or undelivered messages.

11. Limitation of Liability

Swift Car Rental & Towing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or the rental vehicle. Our total liability for any claim arising from a rental is limited to the amount you paid for that rental. We are not responsible for delays, cancellations, or failures due to circumstances beyond our reasonable control, including weather, road conditions, or mechanical issues.

12. Indemnification

You agree to indemnify and hold harmless Swift Car Rental & Towing, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the vehicle, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Towing Services

Towing services provided by Swift Car Rental & Towing are subject to separate terms that will be communicated at the time of service. Towing service availability, pricing, and response times vary and are confirmed when you contact us. Swift Car Rental & Towing is not liable for damage to vehicles during towing except where caused by our own negligence or willful misconduct.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Marion County, Indiana. You waive any objection to venue or jurisdiction in these courts.

15. Changes to These Terms

Swift Car Rental & Towing reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
